Understanding how the Colorado divorce process works

Colorado is a no-fault divorce state. This means that either spouse can file for divorce by simply alleging an irretrievable breakdown of the marriage, a standard that is nearly always met. Unlike most other states, Colorado does not allow divorces based on fault. This means that a family law court will not take infidelity, abuse or abandonment into account when deciding whether to grant a divorce, although the court may consider fault in determining maintenance/alimony and asset/debt allocation matters.

To meet the state’s residency requirement, at least one spouse must have lived in Colorado for 91 days before filing a divorce petition, at a fee of $230. Depending on whether you and your spouse are able to work together to agree on the issues involved, a divorce can take anywhere from a few months to years to resolve.
